Mortgage Payment Giveaway Contest Rules
NO PURCHASE NECESSARY TO WIN.
1. Eligibility: “The Giveaway” is open to current or future residents of the State of Louisiana who are at least twenty one (21) years old at the time of entry and currently own, rent or who are seeking to purchase, rent or sell a residential property in the (225) area code during the inclusive dates of the giveaway. Void where prohibited. Employees, officers, and representatives of Smart Move Real Estate as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The giveaway is subject to all applicable federal, State, local laws and regulations. Participation in the Giveaway constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Giveaway. Winning a prize is contingent upon fulfilling all requirements set forth herein.
THE MONTHLY WINNER OF THE MORTGAGE PAYMENT or OR RENT PAYMENT GIVEAWAY must be an eligible person currently paying rent or a mortgage payment, or intends on purchasing or renting a property in the (225) area code of the Greater Baton Rouge market area within twelve months of the date of being notified of being the winning party. THE GIVEAWAY PAYMENT SHALL BE MADE ONLY UPON A RESIDENTIAL PROPERTY WHICH IS LOCATED WITHIN THE (225) AREA CODE AND IS OWNED OR LEASED BY THE WINNING PARTY. The maximum payment which shall be paid to the winner shall not exceed $2500 regardless of the actual rent or mortgage payment made by the winner.
ENTRANTS WINNING TRANSACTION COST SAVING CERTIFICATES shall receive a certificate which may be redeemed within a 12 month period from date of issuance. Winners receiving certificates for payment of the cost of a professional home inspection and/or Wood Destroying Insect Report (WDIR), or the cost of the appraisal for the purchase of a new residential property must notify Promoter of their intention to redeem their certificate within three (3) business days of receiving a fully executed, accepted Purchase Agreement for a property located within the (225) area code of the Greater Baton Rouge market area.
Timing: The Giveaway shall begin accepting entrants on July 1st, 2016 at 12:00 a.m. Central Time. The first drawing shall be August 1st, 2016. The winning entrant shall be notified within 3 days of the drawing and awarded payment within five business day of notification. NEW WINNERS WILL BE DRAWN THE LAST DAY OF THE MONTH PRECEDING THE MONTH OF THE MORTGAGE/RENT PAYMENT CURRENTLY BEING PAID TO THE WINNER and shall be awarded in the same manner as the initial winner.
OPTING OUT OF ELECTRONIC COMMUNICATIONS FROM SMARTMOVE225.COM shall cause removal of the party’s entry form from consideration to win or redeem any prize provided by the Giveaway.
(The Sweepstakes may be terminated by the Promoter at any time without notice after the fulfillment of the initial prize giveaway.)
Promoter’s computer is the official time-keeping device for the Sweepstakes.

Enter by Mail: Hand print your name, address, day and evening phone numbers, email address, and date of birth on a 3″ x 5″ piece of paper and mail it in an envelope with proper postage to Smart Move Real Estate, 4561 Durham Place, Suite A, Baton Rouge, LA 70816. You will receive one (1) entry into for the initial prize drawing and all subsequent drawings for prize giveaways. All mail-in entries must be handwritten and must be received by Sponsor on or before the last day of the inclusive dates of the contest. All entries become the exclusive property of Sponsor and Promoter and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by the Promoter. The Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, misdirected or postage-due entries, which will be disqualified.
Limit: Each family household may enter one time during the Promotion Period. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant’s entry and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. The Promoter is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration or play, the authorized account holder of the email address used to register will be deemed to be the registrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being the authorized account holder.
ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY THE PROMOTER OR ADMINISTRATOR, WHO’S DECISIONS ARE FINAL AND BINDING. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY AND THE POTENTIAL WINNING ENTRY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
The Sweepstakes Selection and Verification of Potential Winners: All selected potential winners must comply with all terms and conditions of these Official Rules and all winnings are contingent upon fulfilling all requirements. In the event that a potential winner of the prize is disqualified for any reason, Promoter will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.
Taxes: The winner will be responsible for any and all state or federal taxes which may result from the receipt of the proceeds paid to them by the sweepstakes sponsor.
Publicity: Except where prohibited, participation in the Giveaway constitutes winner’s consent to Sponsor’s use of winner’s name, likeness, photograph, voice, opinions, biographical information, hometown, and state for promotional purposes in any media without further payment or consideration. Winner agrees to make themselves available for interviews and photo shoots which may be utilized by the Sponsor to advertise and promote themselves, and/or future Giveaway, or promotion.
General Conditions: The Promoter reserves the right to cancel or modify the Giveaway if fraud, technical failures, or any other factor beyond Promoter’s reasonable control impairs the integrity of the Giveaway, as determined by the Promoter in its sole discretion. In such event, Promoter reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Promoter reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the sweepstakes, or to be acting in violation of these Official Rules or those of any other Promotion, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Giveaway Sweepstakes is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Promoter’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Release: By receipt of any prize, winner agrees to release and hold harmless Promoter, and any promotional partners or advertisers who may present their products or services on one or more websites which promote the sweepstakes and/or any other media in which an advertiser may be promoted by the Sponsor or Administrator. This hold harmless shall include, but not be limited to, each of their parent, subsidiary, affiliate, and related companies, and each of its and their respective officers, directors, employees, and agents (collectively the “Released Parties”) from and against any losses, damages, rights, claim, or cause of action of any kind arising, in whole or in part, directly or indirectly, out of participation in the Sweepstakes or resulting directly or indirectly, from acceptance, possession, use, or misuse of any prize awarded in connection with the Sweepstakes, including without limitation personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy.
Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines, or network hardware, or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes, or receipt, or use of any prize or while traveling to or from any prize-related activity. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, provided that, if it is not possible to award another entry due to discontinuance of the Sweepstakes for any reason, Administrator, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming, or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Administrator reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
Disputes: Entrant agrees that: (i) any and all disputes, claims, and causes of action arising out of or connected with this sweepstakes or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court of Louisiana in East Baton Rouge Parish, Louisiana. (ii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and the Administrator and/or Sponsor in connection with the sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Louisiana, without giving effect to any choice of law or conflict of law rules (whether of the State of Louisiana or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Louisiana.
Winner List: Winner List requests will only be accepted after the promotion end date (listed above) and no later than December 30th, 2016.
Advertiser Indemnification: Advertisers and company sponsors of the Giveaway Sweepstakes are in no way responsible for the administration of, or payment of any prizes awarded by the Sweepstakes or associated or ancillary prizes which may be awarded. Entrant agrees to hold harmless any Sponsor and/or advertiser which may promote its company and/or products and services on the sweepstakes website or any other website or media source which the advertiser and or it’s products or service may be promoted by the Advertiser or the Promoter.
Opt In: Entrant understands and agrees that by providing the Promoter your information to enter the sweepstakes you are agreeing to receive marketing information via direct mail, emails and/or phone calls from the Promoter. and/or sponsors and advertisers which may present their products and services on one or more of the Promoter’s promotional media and/or websites.
Changes to contest rules: The Promoter reserves the right to change, amend or add to these rules as it deems necessary. Rules posted at the time of sweepstakes drawing shall be deemed the binding rules applicable to entrants and sweepstakes winner.
